Flood Control Management Bylaw

This Southland Flood Control Management Bylaw 2010 has been prepared under the Local Government Act 2002, to make provision for the protection and management of flood control works undertaken by, or on behalf of the Council. This Bylaw shall come into force on 7 August 2010 and shall apply to all flood control works, including;

  1. any dam, weir, bank, carriageway, groyne reservoir;
  2. any structure or appliance of any kind;
  3. any drain, excavation, floodway;
  4. any vegetation planting;

that is managed by or on behalf of the Council and that has or is intended to have the effect of stopping, diverting, controlling, restricting or otherwise regulating the flow or spread of flood water in or out of a body of water or the flow or spread of flood water including surface flood water.

Management, regulation and protection of these flood protection works is necessary in order to ensure the effective operation of Council's flood protection assets. This Bylaw replaces the provisions within the Transitional Plan with regard to the protection and management of flood control works.
